1. GENERAL INFORMATION
These Terms & Conditions apply to all customers, visitors, and users who purchase from or interact with KISS Surfing in any way. If you do not agree to these Terms, you should not purchase from us or use our products.
2. ELIGIBILITY
You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order or use our products.
3. PRODUCTS & SERVICES
KISS Surfing sells surf-related products, including the KISS Surfing Surf Setter and other related merchandise and accessories.
We reserve the right to modify or discontinue products at any time, update product availability, descriptions, pricing, or policies without notice, and refuse service or orders at our discretion.
4. PRICING & PAYMENTS
All prices are listed in U.S. Dollars (USD) unless otherwise stated.
We accept: Credit Card, Debit Card, Venmo, PayPal, or Cash.
We reserve the right to refuse or cancel an order for any reason including payment issues, suspected fraud, or product availability.
5. ORDER PROCESSING
Orders are processed within 2 business days unless otherwise stated. Processing time does not include shipping transit time.
6. SHIPPING & DELIVERY
Shipping times and rates vary and are provided at checkout or at the time of purchase.
KISS Surfing is not responsible for shipping delays caused by the carrier, incorrect shipping addresses provided by the customer, or packages lost, delayed, stolen, or damaged after delivery confirmation.
7. RETURNS & REFUNDS
We accept returns within 10 days of delivery.
To be eligible for a return: the request must be made within 10 days of delivery and the item must be unused and in original condition.
If approved, refunds will be issued to the original payment method within 15 business days after the return is received and processed.
8. CUSTOM ORDERS
KISS Surfing does not offer custom orders at this time.
9. CANCELLATIONS
All orders are final and cannot be canceled once placed.
10. PROMOTIONS & DISCOUNT CODES
KISS Surfing does not offer promotions or discount codes at this time.11. INTELLECTUAL PROPERTY
All content, trademarks, product names, logos, images, and designs are the property of KISS Surfing and may not be copied, reproduced, distributed, or used without written permission.
12. USER CONDUCT
You agree not to misuse KISS Surfing products or services, including using the website or products for unlawful purposes, attempting to disrupt or damage our website or brand, or misrepresenting our products or business.
We reserve the right to refuse service to anyone violating these Terms.
13. LIMITATION OF LIABILITY / ASSUMPTION OF RISK
To the fullest extent permitted by law, KISS Surfing is not responsible or liable for any damages, injuries, losses, or claims arising out of or related to the purchase or use of our products, including:
- Damage to products
- Property damage
- Bodily injury
- Death
- Accidents, misuse, or improper installation
- Use of the product in unsafe conditions
- Failure to follow instructions, warnings, or safety recommendations
The KISS Surfing Surf Setter requires safe and responsible operation. The user assumes all risks associated with use of the product, including risks caused by operator error, poor driving ability, inexperience, unsafe handling, or failure to operate responsibly.
KISS Surfing is not responsible for any damage or harm caused due to operator error, lack of driving skill, or unsafe use of the KISS Surfing Surf Setter. In all cases, KISS Surfing’s maximum liability is limited to the purchase price paid for the product.
14. DISCLAIMERS
All products and services are provided “as is” and “as available.” KISS Surfing makes no guarantees of uninterrupted availability or error-free service.
Use all products responsibly and as intended.
15. PRIVACY
Your use of our website and services is subject to our Privacy Policy. We respect your privacy and do not sell your personal information.
16. CHANGES TO THESE TERMS
We may update these Terms & Conditions at any time. Updates become effective immediately upon posting. Continued use means you accept any updated Terms.

These Terms & Conditions are governed by and interpreted in accordance with the laws of the State of Texas, United States.
